Backyard Adventures:

BACKYARD ADVENTURES LIMITED WARRANTY FOR TREEHOUSE, PEAK, AND SUMMIT OUTLOOK SERIES BRANDS

This Limited Warranty applies to products manufactured by or on behalf of BACKYARD ADVENTURES^®, Inc. under the Treehouse^™ Series, Peak^™ Series, Summit Outlook^™ Series.

All above ground wood components, Rocket Slides^™, powder-coated steel components, and hardware are covered by a Limited Lifetime Warranty, that is, they are warranted for so long as the original owner owns such parts, accessories and components against rot and decay or defects in workmanship and materials that affect the structural integrity of the parts, accessories, and components. In the event of any rot, decay or defect during the period, BACKYARD ADVENTURES^® will remedy the defect as described herein, without charge to the purchaser for parts, as soon as practical. The remedy will consist of repair or replacement of the product, or refund of the purchase price, at the discretion of BACKYARD ADVENTURES^® after opportunity to inspect the alleged defect or photographs thereof. However, BACKYARD ADVENTURES^® will not elect to refund the purchase price unless it is unable to provide a replacement, and repair is not commercially practicable or cannot be made within a reasonable time. All freight and labor charges will be the responsibility of the purchaser.

BACKYARD ADVENTURES^®, Inc. warrants that this product will be free from defects in materials and workmanship for a period of five (5) years from the original date of purchase. This five (5) year warranty covers all parts not mentioned in the above Limited Lifetime Warranty. In the event of any such defect during the five-year warranty period, BACKYARD ADVENTURES^® will remedy the defect as described herein, without charge to the purchaser for parts, as soon as practical. The remedy will consist of repair or replacement of the product, or refund of the purchase price, at the discretion of BACKYARD ADVENTURES^® after opportunity to inspect the alleged defect or photographs thereof. However, BACKYARD ADVENTURES® will not elect to refund the purchase price unless it is unable to provide a replacement, and repair is not commercially practicable or cannot be made within a reasonable time. All freight and labor charges will be the responsibility of the purchaser.

In addition, within the first 30 days from date of purchase, BACKYARD ADVENTURES^® will replace any parts found to be missing from or damaged in the original packaging.

This warranty applies to the original owner and registrant only and is non-transferable. Regular maintenance is required to assure maximum life and performance of this product and failure by the owner to maintain the product according to the maintenance requirements may void this warranty. Maintenance guidelines are provided in the Owner’s Manual.

This Limited Warranty does not cover:

Labor for any inspection.
Labor for replacement of any defective item(s).
Incidental or consequential damages.
Cosmetic defects which do not affect performance or integrity of a part or the entire product cosmetic flaws occurring under normal use, such as surface scratches, minor chips, hairline cracks, dents, marring, efflorescence, color fade, discoloration, corrosion/rust, fraying, or warping.
Wood buried below ground level.
Products to which non-Backyard Adventure parts have been added or substituted.
Damage due to environmental factors (such as wind-blown sand, salt spray, or airborne emissions from industrial sources).
Vandalism, improper use, failure due to loading or use beyond the capacities stated in the applicable Assembly Manual.
Acts of nature including but not limited to wind, storms, sandstorms, lightning, tornadoes, earthquakes, hail, floods, excessive water exposure.
Improper installation including but not limited to failure by the installer to follow all instructions, guides or directions, or failure to use the appropriate Concrete Anchoring Kit.
Installation on uneven, unlevel, or soft ground.
Minor twisting, warping, checking, or any other natural occurring properties of wood that do not affect performance or integrity.
Freight and/or shipping costs for replacement parts.

Backyard Adventures does not warrant that any color will be available for any specific period, and reserves the right, in its sole discretion, to discontinue any color for any reason.

BACKYARD ADVENTURES^® products have been designed for safety and quality. Any modifications made to the original product could damage the structural integrity of the unit leading to failure and possible injury. Modification of the original product voids any and all warranties and BACKYARD ADVENTURES^® assumes no liability for any modified products or consequences resulting from failure of a modified product.

These Limited Warranties apply to play sets purchased for and/or used in RESIDENTIAL USE ONLY.

Under no circumstance should a BACKYARD ADVENTURES^® Summit Outlook^™ Series product be used in public settings such as schools, churches, playgrounds, parks, day cares and the like. Such use may lead to product failure and potential injury. Any and all public use will void this warranty. Backyard Adventures^® disclaims all other representations and warranties of any kind, expressed or implied. This Warranty gives you specific legal rights. You may have other rights as well which vary from state to state or province to province. This warranty excludes all consequential damages; however, some states do not allow the limitation or exclusion of consequential damages and therefore this limitation may not apply to you.

Eastern Jungle Gym:

Eastern Jungle GymⓇ (“EJG”) warrants all wooden components of its swing sets, under normal use and conditions, for a prorated period of 10 (TEN) years from the date of purchase. The warranty applies to the original purchaser at original address on sales receipt for the Classic, Dreamscape, Dream, Supreme (Oct 2015 and after), Supremescape, Ultimate, Extreme, Sky, Fantasy, Fantasy Tree House and Imagination swing sets. It warrants against structural failure from insect infestation or wood rot. It does not cover rot or decay that occurs as a result of installation of a swing set in an area with poor drainage.

Seasonal checks, minor cracking, knots, knot holes, peeling, warping, splintering, etc. are all considered natural characteristics and cosmetic imperfections of any wooden outdoor play equipment. They do not result in structural failure, and they are not covered under this warranty. Discoloration, mold growth and faded stain on the wooden components, as well as surface rust on hardware, are not considered defects and are not covered under the warranty.

Any components returned to EJG under this limited 10-year warranty must be sent freight prepaid and will be replaced or repaired at Eastern Jungle Gym’s option. Returned components will be sent freight collect. Eastern Jungle Gym® reserves the right to examine photographs and/or physical evidence of merchandise claimed to be defective and to recover merchandise prior to any warranty claims. Any other costs associated with the work that must be performed on site is not covered. Any travel and labor or shipping and handling expenses will be the responsibility of the original purchaser. The warranty described thus far is the original purchaser’s sole and exclusive remedy. It lasts for 10 years, or until the original customer sells or otherwise transfers the unit.

In addition to and separate from the above, all chains, rope, canopy tent tops, seats, hardware, metal braces, handles, rungs and all accessories will be free from defects in material and workmanship for a period of 1 (ONE) year from the date of purchase. Cracks in plastic components, as well as chips and imperfections in the powder-coated finishes, are not considered defects in workmanship or material if they do not affect the functionality of the component or the swing set, and as such will not be covered under this warranty. Any components returned to EJG under this limited one-year warranty will be replaced or repaired at Eastern Jungle Gym’s option. Any costs associated with work that must be performed on-site is not covered, and neither are travel and labor or shipping and handling expenses. Those will be the responsibility of the original purchaser. The warranty described in this paragraph is the original purchaser’s sole and exclusive remedy. It lasts for 1 year, or until the original customer sells or otherwise transfers the unit.

Non-residential use of swing set or any swing set parts (including but not limited to chains, ropes, canopy tent tops, handles, etc.) is prohibited and will not be covered under any warranty, as Eastern Jungle Gym swing sets are designed for residential use ONLY. EJG reserves the right to examine photographs and/or physical evidence of merchandise claimed to be defective, and to recover merchandise prior to any warranty claims. Any merchandise returned for inspection must be sent freight prepaid, and will be returned freight collect, unless return authorization number is issued.

These warranties do not apply to any swing set or swing set part that has been subjected to abuse, vandalism, improper installation, negligence or acts of God. Warranties are void if any alterations or additions have been made to the swing set, or if it has been relocated by the customer or a third party.

These warranties are subject to the limitations stated herein. These warranties are expressly in lieu of all other warranties. They excludes all consequential damages. Some states do not allow the limitation or exclusion of consequential damages, so the above may not apply to you. Eastern Jungle GymⓇ does not authorize any individual or representative to express or imply any other warranty.

Notice: Failure to maintain your equipment properly may cause the warranties described herein not to apply in certain circumstances. It is the owner’s responsibility to perform upkeep on the swing set, which includes but is not limited to hardware checks and regular restaining/resealing.

Swing Kingdom:

Residential Limited Lifetime, 20-Year and 5-Year Warranty

Subject to ordinary residential use and proper installation by a certified SK installer. Swing Kingdom warrants to the original purchaser at the original installation address, that the structural components of the playground systems, such as the PVC plastic lumber and wood components are covered by a 20-year warranty. In addition all canopies, slides, metal components, swings and accessories are warranted for 5 years from date of original purchase.

Swing Kingdom’s products are not warranted as being suitable for a particular purpose. The suitability of the product is for the purchaser to determine. This warranty does not cover normal wear and tear, failure to properly maintain the product, or damage resulting from misuse or abuse of the product, additionally any acts of nature such as lightning, storms, hurricanes, tornados, earthquakes or any extreme weather conditions. Also any alteration, addition or relocation of the product will void this warranty.

Swing Kingdom reserves the right to deny any claim if the playset or product does not have a product registration on file prior to the claim being submitted. If a product registration is not submitted within 45 days of initial installation, a $99 registration fee will apply to register the play set and utilize the warranty. Swing Kingdom reserves the right to examine photographs and/or physical evidence of the product claimed to be defective, and to recover product prior to any warranty claims. All products returned for inspection must be sent freight prepaid. In the event of a defect covered by these warranties, Swing Kingdom will remedy the defect within a reasonable time. The remedy will consist of repair or replacement of the defective piece unless it is not practical. Then Swing Kingdom will reimburse the original purchaser for the value of the defective piece. (All freight cost of replacement parts are not covered under the warranty and will be the purchaser responsibility to cover).

Adult supervision is recommended while enjoying your play system.

For safety and comfort reasons, Swing Kingdom reserves the right to make design & construction changes without notice.

Commercial Limited Lifetime, 10-Year and 5-Year Warranty

Subject to private owned establishment use and proper installation by a certified SK installer. (Sk units are built to meet CPSC guidelines and ASTM standards but have not been tested for the general public use).

Swing Kingdom warrants to the original purchaser at the original installation address, that the structural components of the playground systems, such as the PVC plastic lumber and wood components are covered by a 10-year warranty. In addition all canopies, slides, metal components, swings and accessories are warranted for 5 years from date of original purchase.

Swing Kingdom reserves the right to deny any claim if the playset or product does not have a product registration on file prior to the claim being submitted. If a product registration is not submitted within 45 days of initial installation, a $99 registration fee will apply to register the play set and utilize the warranty.
